Privacy Notice

Akachukwu Properties ("Akachukwu Properties," "we," "us," or "our") is a New York City real estate brokerage. This Privacy Notice explains how we collect, use, disclose, retain, and protect personal information in connection with our business, including our website(s), marketing, open houses, client communications, and brokerage services.

1) Scope of this Privacy Notice

This Privacy Notice applies to personal information we process in connection with:

  • Our websites and any online services that link to this Privacy Notice (the "Services")
  • Prospective, current, and former clients (buyers, sellers, renters, landlords)
  • Visitors who contact us, attend open houses, submit inquiries, or otherwise interact with us

Not covered: This Privacy Notice does not apply to job applicants or employees, or to information covered by a separate notice we may provide for a specific program, transaction, or platform.

2) Personal information we collect

We may collect personal information directly from you, automatically when you use our Services, and from third parties.

A. Information you provide to us

Depending on your interaction with us, we may collect:

  • Contact information: name, email, phone number, mailing address
  • Client and preference information: neighborhoods, price range, desired features, move timeframe, household considerations you choose to share
  • Property information: address, listing details, photos you provide, showing/visit notes, communications regarding a property
  • Transaction-related information: purchase/lease details, documents you provide (e.g., offer-related forms), and communications with other parties involved in the transaction
  • Payments: billing details or payment confirmation if you pay fees through us (we generally use payment processors and do not store full card numbers)
  • Communications: emails, texts, call notes, chat messages, and support requests
  • Open house/sign-in information: name, contact details, and interest indicators (e.g., "working with an agent?")

Sensitive information (only if needed): In limited circumstances we may receive government identifiers or other sensitive information if required to verify identity, prevent fraud, or complete a transaction, but we do not request or use sensitive information for targeted marketing unless permitted by law.

B. Information we collect automatically (online)

When you visit or use our Services, we may collect:

  • Device and browser data: IP address, browser type, device identifiers, operating system, language, general location derived from IP
  • Usage data: pages viewed, links clicked, searches performed, time spent, and referring URLs

This is commonly collected through cookies and similar technologies (see Section 6).

C. Information we receive from third parties

We may receive personal information from:

  • Listing/real estate platforms and partners: MLS/IDX providers, listing syndication partners, showing/appointment platforms, CRM tools
  • Public sources: public property records and government databases (e.g., ownership history, recorded documents)
  • Vendors and service providers: marketing, analytics, IT, and communications providers
  • Transaction counterparties: cooperating brokers/agents, attorneys, landlords, building managers, or others involved in a transaction (as applicable)

3) How we use personal information

We use personal information for purposes such as:

  • Providing brokerage services (responding to inquiries; scheduling showings; preparing, presenting, or communicating offers; facilitating communications among parties)
  • Client relationship management (maintaining our records, communicating with you, providing requested information)
  • Marketing and promotional communications (newsletters, market updates, property alerts), subject to your choices
  • Personalization (tailoring listings or recommendations based on your preferences)
  • Analytics and improvement (understanding how our Services are used, improving content and functionality)
  • Security and fraud prevention (protecting our systems and users; detecting suspicious activity)
  • Legal and compliance (responding to lawful requests; complying with recordkeeping and regulatory obligations)
  • Business transactions (e.g., a merger, acquisition, restructuring, or asset sale)

4) How we disclose personal information

We may disclose personal information to:

A. Service providers (vendors)

We share personal information with vendors that perform services on our behalf (e.g., website hosting, analytics, CRM, email delivery, scheduling, IT support). We require service providers to use information only as needed to provide services to us and to protect it appropriately.

B. Real estate professionals and transaction participants

If you request services or engage in a transaction, we may share information with:

  • Cooperating brokers/agents
  • Sellers/landlords or buyers/renters (as applicable)
  • Attorneys, title companies, inspectors, appraisers, building management, and other parties involved in facilitating a transaction (as appropriate and consistent with your instructions and the transaction context)

C. Marketing/advertising partners (online)

We may disclose limited identifiers and usage data to analytics and advertising partners to measure campaigns and, where applicable, support interest-based advertising (see Section 7).

D. Legal, safety, and business transfers

We may disclose information:

  • To comply with law, legal process, or government requests
  • To protect our rights, safety, and property, and that of others
  • In connection with a business transaction (e.g., merger/acquisition) where permitted by law

We do not knowingly sell personal information for money. If we engage in practices that certain laws define as "sale" or "sharing" (e.g., online ad-tech disclosures), we provide opt-out options where required (see Section 12).

5) Aggregate and de-identified information

We may create and use aggregated or de-identified information (e.g., trends about website usage or market interest) for analytics and service improvement. Where required by law, we maintain and use it in de-identified form.

6) Cookies, tracking, and analytics

We use cookies and similar technologies to: operate and secure our Services, remember preferences, understand usage and performance, and support marketing and advertising measurement. You can usually control cookies through your browser settings. If we implement a cookie banner or preference center, you may also adjust cookie categories there.

7) Interest-based advertising

We (or our partners) may use cookies/pixels to deliver ads that are more relevant to your interests and to measure ad performance. You can opt out of certain interest-based advertising through industry opt-out tools (e.g., the Digital Advertising Alliance) and/or by adjusting cookie settings (if available on our site).

8) Social features and third-party plug-ins

Our Services may include third-party features (e.g., embedded maps, social media widgets). These third parties may collect information directly from your device/browser according to their own privacy policies. We are not responsible for third-party privacy practices.

9) International transfers

Akachukwu Properties operates in the United States. If you access our Services from outside the U.S., your information may be processed in the U.S. or other locations where our vendors operate, subject to contractual and legal protections.

10) Security

We take reasonable steps designed to protect personal information. New York law requires businesses that own or license computerized data containing certain "private information" of New York residents to develop, implement, and maintain reasonable safeguards to protect the security, confidentiality, and integrity of that information. No method of transmission or storage is 100% secure; however, we work to maintain administrative, technical, and physical safeguards appropriate to our size, the nature of the data, and the risks involved.

11) Data retention

We retain personal information for as long as reasonably necessary to:

  • Provide services you request
  • Maintain business and transaction records
  • Comply with legal/regulatory obligations
  • Resolve disputes and enforce agreements

When information is no longer needed, we take reasonable steps to dispose of it consistent with applicable requirements.

12) Your rights and choices

A. Marketing communications

You can opt out of marketing emails by using the unsubscribe link in our messages or by contacting us (see Section 16). Even if you opt out, we may still send non-marketing communications (e.g., responses to your inquiry or transaction-related messages).

B. Cookies and interest-based ads

You may be able to limit cookies via browser settings and (if available) our cookie preference controls.

C. Access, correction, and deletion requests

You may request access to, correction of, or deletion of certain personal information by contacting us. We will consider and respond consistent with applicable law and legitimate business needs (e.g., recordkeeping).

D. New York data breach notification (summary)

If a "breach of the security of the system" involving "private information" of New York residents occurs, New York law requires notice to affected New York residents without unreasonable delay and within 30 days after discovery (subject to limited exceptions such as law-enforcement needs). (Operationally, this is handled through our incident response process and any vendor obligations.)

13) Children

Our Services are not directed to children under 13, and we do not knowingly collect personal information from children under 13.

14) Third-party websites

Our Services may link to third-party sites (listing portals, mortgage calculators, etc.). Third-party privacy practices are governed by their own notices, not this one.

15) Changes to this Privacy Notice

We may update this Privacy Notice from time to time. We will post the updated version with a new "Last updated" date. Material changes may be highlighted on our website or communicated through other appropriate means.
